Welcome to Donut (“we”, “us”, “our”). This comprehensive legal agreement governs your privacy rights and the legally binding terms of use for the Donut desktop application (“Software”), the joindonut.co website (“Site”), and associated services.
Privacy Policy
1. Information We Collect
- Account Information: Name, email address, and authentication credentials provided when creating or activating an account.
- Real-Time Meeting Audio & Transcripts: Audio processed during active sessions is converted to text in real time to generate contextual answers. Audio streams are processed ephemerally and are not permanently recorded or archived once transcribed. Generated answers and transcripts are stored securely to provide your personal session history.
- Usage & Telemetry Data: Operational metrics such as session duration, model routing, and feature interactions used strictly to maintain reliability and enforce subscription allowances.
- Billing Information: Payment status and transaction identifiers. All credit card processing is handled directly by PCI-compliant payment gateways (e.g. Gumroad / Stripe); we never store raw credit card numbers.
- Direct Communications: Inquiries or onboarding conversations initiated via iMessage, WhatsApp, or email to assist with setup and customer service.
2. How We Use Information
We use collected information solely to: (a) operate, compute, and deliver real-time AI assistive responses; (b) authenticate your license; (c) process payments and prevent fraud; and (d) provide technical customer support. We do not sell, rent, monetize, or trade your personal data to third parties.
3. Third-Party Processors & Infrastructure
To provide high-speed inference, we utilize trusted enterprise cloud infrastructure and specialized AI inference providers under strict data privacy and confidentiality agreements. Third-party processors are granted access strictly to perform designated processing tasks and are contractually prohibited from using your data for model training or secondary purposes.
4. Data Retention & User Rights
You retain full control over your personal data. You may request account deletion, data export, or session purging at any time by emailing hey@joindonut.co. Account termination permanently deletes your stored history and license tokens.
Terms & Conditions of Service
1. Legally Binding Agreement
By purchasing, downloading, accessing, or running the Software or Services, you enter into a legally binding agreement with Donut. If you do not accept all terms herein, you are not authorized to use the Services and must immediately uninstall the Software.
2. Proprietary Rights & Strict Anti-Replication Covenant
All source code, compiled binaries, algorithms, prompts, system architectures, models, and brand assets are the exclusive intellectual property of Donut.
Strict Prohibition: You shall not, directly or indirectly: (a) reverse-engineer, decompile, decrypt, extract, or attempt to derive the source code or internal protocols of the Software or APIs; (b) create derivative works or competitive services based on Donut; (c) bypass license keys, window protections, or anti-tamper mechanisms; or (d) resell, distribute, or lease your account credentials.
3. Strict No-Refund Policy & Subscriptions
All Sales Are 100% Final and Non-Refundable: Due to the immediate delivery, digital nature, and live computational GPU/cloud infrastructure provisioned instantly upon checkout, Donut enforces a strict no-refund policy. We do not issue refunds, credits, or chargeback reimbursements under any circumstance.
Subscriptions renew automatically unless canceled prior to the renewal date via your account link. Cancellation halts future charges but does not entitle the user to a refund of any prior payments.
4. Independent Responsibility & Total Third-Party Liability Shield
Donut is an assistive software tool. You alone determine the context, propriety, and manner in which you deploy the Software.
Compliance with Third-Party & Institutional Rules: You represent and warrant that your use of Donut fully complies with all applicable workplace rules, employment agreements, non-disclosure agreements, academic policies, interview guidelines, and local recording consent laws.
Complete Shield Against Third-Party Action: In no event shall Donut be held legally or financially liable for any disciplinary action, employment termination, lost offer, candidate disqualification, or lawsuit initiated against you by any employer, interviewer, client, or institution. You assume 100% of all legal, financial, and professional risk arising from your use of the Software.
5. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DONUT DOES NOT PROMISE OR GUARANTEE SPECIFIC INTERVIEW PASS RATES, JOB OFFERS, SALARIES, OR ACCURACY OF AI OUTPUTS.
6. Comprehensive Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DONUT OR ITS FOUNDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. DONUT'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO DONUT IN THE THIRTY (30) DAYS PRECEDING THE CLAIM, OR $50.00 USD, WHICHEVER IS LESS.
7. Complete Indemnification
You agree to defend, indemnify, and hold harmless Donut, its officers, and affiliates from and against any claims, liabilities, damages, losses, and legal expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or any third-party dispute resulting from your use of Donut.
8. Binding Individual Arbitration & Class Action Waiver
All disputes arising under these Terms shall be settled through final, confidential, and binding individual arbitration. You expressly waive any right to bring or participate in any class action, collective lawsuit, or representative proceeding against Donut.
9. Termination
We reserve the right to immediately terminate or revoke your license and access without notice or refund upon any breach of these Terms, unauthorized code tampering, or abusive activity.
